CRIMINAL LAW FAQ
Georgia only has DUI per se, DUI less safe, and DUI drugs. DUI per se happens when a blood alcohol level is .08 or above. DUI less safe is when no proof of blood alcohol level is available. DUI drugs is when an individual is under the influece of some kind of drug that affects the ability to drive.

A 1st or 2nd DUI conviction is a misdemeanor. A 3rd DUI conviction is high and aggravated misdemeanor.
