Family Violence in Georgia

Under O.C.G.A. §19-13-1 defines family violence as “acts between past or present spouses, persons who are parents of the same child, parents and children, stepparents and stepchildren, foster parents and foster children, or other persons living or formerly living in the same household.” This can include felony and misdemeanor charges of battery, assault, stalking, criminal damage to property, unlawful restraint, or criminal trespass. Penalties for family violence offenses are most often greater than the penalties for the same acts against non-family members.

Temporary Protective Order (TPO) vs. Criminal Charges

In Georgia, temporary protective orders (TPOs) are issued in civil court and provide protection for an individual who believes they are in imminent danger from family violence or stalking by ordering the offender to keep their distance and avoid any contact. These orders are typically issued for a period of 30 days or less, and serve as a temporary protection until a formal hearing or trial can be held. Violation of a TPO in Georgia can lead to jail time and fines. In addition to being held in Contempt of Court, violators can be subject to other criminal charges, most often criminal Violation of PTO and aggravated stalking.
